为保障统计调查对象的合法权益,规范和监督统计机关行政执法行为,提高统计机关依法行政能力和水平,根据《中华人民共和国行政处罚法》、《中华人民共和国行政诉讼法》、《中华人民共和国行政复议法》、《中华人民共和国行政复议法实施条例》、《中华人民共和国行政许可法》、《中华人民共和国国家赔偿法》、《中华人民共和国统计法》和《涉外调查管理办法》等法律、法规的有关规定,特将统计行政执法相对人权益告知如下:

1、统计调查表未标明表号、制定机关、批准或者备案文号、有效期限等标志,或者统计调查表超过有效期限的,统计调查对象有权拒绝填报。

2、统计人员进行统计调查时,应当出示县级以上人民政府统计机构或者有关部门颁发的工作证件;未出示的,统计调查对象有权拒绝调查。

3、县级以上人民政府统计机构进行监督检查时,监督检查人员不得少于二人,并应当出示执法证件;未出示的,有关单位和个人有权拒绝检查。

4、涉外调查许可证的有效期为三年。涉外调查机构需要延续涉外调查许可证有效期的,应当在有效期届满三十日前向原颁发机关提出申请。逾期未提出的,将不再延续涉外调查许可证的有效期。

5、公民、法人或者其他组织对行政机关实施行政许可,享有陈述权、申辩权;有权依法申请行政复议或者提起行政诉讼;其合法权益因行政机关违法实施行政许可受到损害的,有权依法要求赔偿。

6、公民、法人或者其他组织依法取得的行政许可受法律保护,行政机关不得擅自改变已经生效的行政许可。

7、公民、法人或者其他组织可以向行政许可的设定机关和实施机关就行政许可的设定和实施提出意见和建议。

8、行政机关应当将法律、法规、规章规定的有关行政许可的事项、依据、条件、数量、程序、期限以及需要提交的全部材料的目录和申请书示范文本等在办公场所公示。申请人要求行政机关对公示内容予以说明、解释的,行政机关应当说明、解释,提供准确、可靠的信息。

9、公民、法人或者其他组织对行政机关所给予的行政处罚,享有陈述权、申辩权;对行政处罚不服的,有权依法申请行政复议或者提起行政诉讼。公民、法人或者其他组织因行政机关违法给予行政处罚受到损害的,有权依法提出赔偿要求。

10、行政机关在作出行政处罚决定之前,应当告知当事人作出行政处罚决定的事实、理由及依据,并告知当事人依法享有的权利。当事人有权进行陈述和申辩。

11、行政机关作出责令停产停业、吊销许可证或者执照、较大数额罚款等行政处罚决定之前,应当告知当事人有要求举行听证的权利。当事人可以亲自参加听证,也可以委托一至二人代理。

12、当事人认为行政机关执法人员,或者听证主持人与案件有直接利害关系的,有权申请回避。

13、公民、法人或者其他组织对行政机关作出的行政处罚,有权申诉或者检举。行政机关应当认真审查,发现行政处罚有错误的,应当主动改正。

14、当事人确有经济困难,需要延期或者分期缴纳罚款的,经当事人申请和行政机关批准,可以暂缓或者分期缴纳。

15、公民、法人或者其他组织对行政机关作出的警告、罚款、没收违法所得、没收非法财物、责令停产停业、暂扣或者吊销许可证、暂扣或者吊销执照、行政拘留等行政处罚决定不服的,可以依法申请行政复议。

16、公民、法人或者其他组织对行政机关作出的有关许可证、执照、资质证、资格证等证书变更、中止、撤销的决定不服的,可以依法申请行政复议。

17、公民、法人或者其他组织认为符合法定条件,申请行政机关颁发许可证、执照、资质证、资格证等证书,或者申请行政机关审批、登记有关事项,行政机关没有依法办理的,可以依法申请行政复议。

18、公民、法人或者其他组织认为具体行政行为侵犯其合法权益的,可以自知道该具体行政行为之日起六十日内提出行政复议申请;但是法律规定的申请期限超过六十日的除外。

19、公民、法人或者其他组织对行政复议决定不服的,可以依照行政诉讼法的规定向人民法院提起行政诉讼,但是法律规定行政复议决定为最终裁决的除外。

20、依照行政复议法和行政复议法实施条例规定,申请行政复议的公民、法人或者其他组织为申请人,作出具体行政行为的行政机关为被申请人。申请人申请行政复议,可以书面申请,也可以口头申请。申请人书面申请行政复议的,可以采取当面递交、邮寄或者传真等方式提出行政复议申请。

21、申请人、第三人可以委托1至2名代理人参加行政复议。申请人、第三人委托代理人的,应当向行政复议机构提交授权委托书。

22、对县级以上地方各级人民政府工作部门的具体行政行为不服的,由申请人选择,可以向该部门的本级人民政府申请行政复议,也可以向上一级主管部门申请行政复议。

23、行政复议申请人、第三人可以查阅被申请人提出的书面答复、作出具体行政行为的证据、依据和其他有关材料,除涉及国家秘密、商业秘密或者个人隐私外,行政复议机关不得拒绝。

24、行政复议决定作出前,申请人要求撤回行政复议申请的,经说明理由,可以撤回;撤回行政复议申请的,行政复议终止。

25、行政复议申请人不服复议决定的,可以在收到复议决定书之日起十五日内向人民法院提起诉讼。复议机关逾期不作决定的,申请人可以在复议期满之日起十五日内向人民法院提起诉讼。法律另有规定的除外。

26、公民、法人或者其他组织认为行政机关和行政机关工作人员的具体行政行为侵犯其合法权益,有权依法向人民法院提起诉讼。

27、对属于人民法院受案范围的行政案件,公民、法人或者其他组织可以先向上一级行政机关或者法律、法规规定的行政机关申请复议,对复议不服的,再向人民法院提起诉讼;也可以直接向人民法院提起诉讼。

28、公民、法人或者其他组织直接向人民法院提起诉讼的,应当在知道作出具体行政行为之日起三个月内提出。法律另有规定的除外。

29、当事人不服人民法院第一审判决的,有权在判决书送达之日起十五日内向上一级人民法院提起上诉。当事人不服人民法院第一审裁定的,有权在裁定书送达之日起十日内向上一级人民法院提起上诉。逾期不提起上诉的,人民法院的第一审判决或者裁定发生法律效力。

30、当事人对已经发生法律效力的判决、裁定,认为确有错误的,可以向原审人民法院或者上一级人民法院提出申诉,但判决、裁定不停止执行。

31、公民、法人或者其他组织的合法权益受到行政机关或者行政机关工作人员作出的具体行政行为侵犯造成损害的,有权请求赔偿。

32、法律、法规规定的其他权利。

凡上述引用的现行法律法规相关条款内容有所调整或者修改的,应当以调整或者修改后的内容为准。

当事人对统计机关作出的具体行政行为不服的,可以依法申请行政复议或者提起行政诉讼;对统计机关及其行政执法人员的违法失职行为或者在统计执法过程中违反工作纪律的行为,有权向统计机关监察部门检举。

Rights and Interests of the Counterpart of Administrative Law Enforcement of the Statistics Organs

With a view to safeguarding the counterpart’s legitimate rights and interests, normalizing and supervising administrative law enforcement acts, raising the capability and level of administration-by-law, and on the basis of the“Administrative Punishment Law of the People’s Republic of China”, the“Administrative Procedure Law of the People’s Republic of China”, the“Administrative Reconsideration Law of the People’s Republic of China”, the“Implementation Rules of the‘Administrative Reconsideration Law of the People’s Republic of China’”, the“Administrative Permit Law of the People’s Republic of China”, the“State Compensation Law of the People’s Republic of China”, the“Statistics Law of the People’s Republic of China”, and the“Procedures on the Administration on Foreign-related Investigation”, the rights and interests of the counterpart of administrative law enforcement are hereby announced as follows:

1. Where a statistical questionnaire has no serial number, formulating organ, approval document or file number, term of validity or other marks indicated, or exceeds the term of validity, the person to whom the questionnaire is directed has the right to refuse to fill in the questionnaire.

2. A statistician conducting statistical survey shall produce his or her ID card issued by the statistics organ or relevant department of the people’s government at or above the county level; in the case of no production thereof, the counterpart of the statistical survey has the right to refuse the survey.

3. When a statistics organ of the people’s government at or above the county level is carrying out supervision and inspection, supervisors or inspectors shall be not less than two in number and shall produce the law-enforcement certificate; in the case of no production thereof, the related unit or person has the right to refuse the inspection.

4. The term of validity of a permit for foreign-related investigation is three years. The foreign-related investigation organ, if needing to extend the term of validity of the permit therefor, shall make an application to the original issuing organ 30 days before the expiration. If no application is made within the time limit, the term of validity of the permit therefor shall not be extended.

5. With regard to an administrative organ’s administering an administrative permit, every citizen, legal person or other organization has the right to make presentation and defense, to apply for administrative reconsideration or to file an administrative lawsuit in accordance with law; and has the right to claim compensation according to law if its legitimate rights and interests are impaired because of an administrative organ’s unlawful implementation of the administrative permit.

6. The administrative permit obtained by a citizen, a legal person, or other organization in accordance with law shall be protected by law. No administrative organ shall arbitrarily change an administrative permit that has come into effect.

7. Every citizen, legal person, or other organization may put forward opinions and suggestions to the organ setting up and executing the administrative permit about the setting-up and execution thereof.

8. An administrative organ shall display the matters, bases, conditions, quantity, procedures and time limit in relation to the administrative permit provided by laws, rules and regulations, as well as the catalogue of all materials to be submitted and the sample application text at its office place. Where an applicant asks the administrative organ to give explanations or interpretation about the displayed contents, the administrative organ shall do so and provide accurate and reliable information.

9. With regard to an administrative punishment imposed by an administrative organ, every citizen, legal person, or other organization has the right to make presentation and defense; any party aggrieved by the administrative punishment has the right to apply for administrative reconsideration or file an administrative lawsuit in accordance with law. Any citizen, legal person, or other organization has the right to claim compensation according to law for damage caused by an administrative organ’s illegal imposition of administrative punishment.

10. Before deciding to impose an administrative punishment, an administrative organ shall notify the party of the facts, reasons, and bases on which the administrative punishment is to be decided, and shall notify the party of the rights that they enjoy in accordance with law. The party has the right to make presentation and defense.

11. Before making an administrative punishment decision involving order for suspension of production or business, rescission of business license, or imposition of a comparatively large amount of fine, an administrative organ shall notify the party of the right to request a hearing. The party may participate in the hearing in person or entrust one or two attorneys.

12. The party has the right to apply for the withdrawal of any law-enforcer of an administrative organ or the person presiding over the hearing who, in the opinion of the party, has direct interests with the case.

13. Every citizen, legal person, or other organization has the right to make an appeal or accusation against an administrative punishment imposed by an administrative organ. The administrative organ shall conscientiously examine the appeal or accusation, and take the initiative to make correction on finding any incorrect administrative punishment.

14. Where a party truly has financial difficulties, demanding delayed or installment payments of a fine, payment may be postponed or divided upon application by the party and approval by the administrative organ.

15. Any citizen, legal person, or other organization aggrieved by an administrative punishment decision made by an administrative organ such as warning, fine, confiscation of illegal gains or illegal property, order for suspension of production or business, suspension or revocation of permit or license, administrative detention may apply for administrative reconsideration according to law.

16. Any citizen, legal person, or other organization aggrieved by a decision made by an administrative organ concerning the alteration, suspension, or cancellation of a permit, license, or qualification certificate may apply for administrative reconsideration according to law.

17. Any citizen, legal person, or other organization being of the opinion that an administrative organ fails to issue a permit, license, or qualification certificate despite compliance with legal conditions or fails to handle according to law examination, approval, or registration of relevant matters it applied for may apply for administrative reconsideration according to law.

18. Any citizen, legal person, or other organization being of the opinion that a specific administrative act has infringed on its legitimate rights and interests may apply for administrative reconsideration within 60 days from the date of such specific administrative act coming into its knowledge, except that the time limit provided by law for application exceeds 60 days.

19. Any citizen, legal person, or other organization aggrieved by an administrative reconsideration may, in accordance with the provisions of the“Administrative Procedure Law”, file an administrative lawsuit in the people’s court, except that the administrative decision is, as provided by law, the final decision.

20. According to the provisions of the“Administrative Reconsideration Law”and the“Implementation Rules of the Administrative Reconsideration Law”, a citizen, legal person, or other organization applying for administrative reconsideration is a claimant and an administrative organ that made a specific administrative act is a respondent. The claimant may apply for administrative reconsideration orally or in writing. The claimant making a written application for administrative reconsideration may adopt the modes of submission in person or by mail or fax.

21. A claimant or a third party may entrust one or two attorneys to participate in the administrative reconsideration. The claimant or third party, if entrusting an attorney, shall submit the power of attorney to the administrative reconsideration organ.

22. A claimant aggrieved by a specific administrative act made by a department under local people’s government at or above the county level may, at discretion, apply for administrative reconsideration to the people’s government at the corresponding level to which the department belongs, or to the competent administrative department at a higher level.

23. A claimant or a third party for administrative reconsideration may consult the written reply and the evidence, bases as well as other relevant materials on which a specific administrative act was made put forward by the respondent, and the administrative reconsideration organ shall not refuse the consultation unless State secrets, business secrets, or privacy is involved.

24. If the claimant requests the withdrawal of an application for administrative reconsideration before the making of an administrative reconsideration decision, the withdrawal thereof is allowed upon explanation of reasons; the administrative reconsideration shall be terminated where the application is withdrawn.

25. The claimant for administrative reconsideration aggrieved by the reconsideration decision may file an administrative lawsuit in the people’s court within 15 days from the date of receiving the reconsideration decision paper. Where the administrative reconsideration organ fails to make a decision within the prescribed time limit, the claimant may, within 15 days from the expiration date of the reconsideration, file a lawsuit in the people’s court, unless laws provide otherwise.

26. Any citizen, legal person, or other organization being of the opinion that a specific administrative act of an administrative organ or its personnel infringes on its legitimate rights and interests has the right to file a lawsuit in the people’s court.

27. With respect to an administrative case that belongs in the case-undertaking scope of the people’s court, a citizen, legal person, or other organization may first apply to the upper-level administrative organ or the administrative organ for reconsideration provided by laws and regulations, and then file a lawsuit in the people’s court in case of dissatisfaction with the reconsideration decision; or may file a lawsuit directly in the people’s court.

28. A citizen, legal person, or other organization that directly files a lawsuit in the people’s court shall do so within three months from the date of a specific administrative act coming into its knowledge, unless otherwise provided by the law.

29. A party that refuses to accept a judgment of first instance made by the people’s court has the right to appeal to the higher-level people’s court within 15 days from the date of service of the judgment. The party that refuses to accept the ruling of first instance made by the people’s court has the right to appeal to the higher-level people’s court within 10 days from the date of service of the ruling. If the party does not appeal within the prescribed time limit, the judgment or ruling of first instance made by the people’s court comes into legal effect.

30. The party considering the judgment or ruling that has come into legal effect really wrong may lodge a complaint to the original people’s court handling the case or the higher-level people’s court, but the execution of judgment or ruling shall not be stopped.

31. A citizen, legal person, or other organization having its legitimate rights and interests infringed on and harmed by a specific administrative act made by an administrative organ or its personnel has the right to claim compensation.

32. Other rights as may be provided by laws and regulations.

If there are any adjustments or amendments in the contents of relevant clauses of current laws and regulations as quoted above, the changed or amended contents prevail.

A party aggrieved by a specific administrative act made by the statistics organ may apply for administrative reconsideration or file an administrative lawsuit in accordance with law; in respect to any illegal act or neglect of duty of the statistics organ and its administrative law-enforcers, or with regard to any act in violation of work disciplines in the process of statistical law enforcement, the party has the right to report to the supervisory department of the statistics organ.
